Texas Dream Act Upheld—A Victory for Access, Opportunity, and Economic Growth

In a major win for immigrant families and the future of Texas, legislative efforts to repeal the Texas Dream Act were defeated during the 89th Texas Legislative Session. Despite nine separate bills—including HB 232 and SB 1798—none passed, preserving the state's landmark 2001 law that ensures in-state tuition for undocumented high school graduates who meet certain residency and educational requirements.
 
Originally passed with bipartisan support, the Texas Dream Act allows undocumented students to attend public colleges and universities at the same in-state tuition rates as their peers, provided they:
• Have lived in Texas for at least three years,
• Graduated from a Texas high school or obtained a GED, and
• Sign an affidavit stating their intent to seek legal status.
 
For undocumented immigrants, this law removes one of the biggest barriers to higher education: affordability. By making college more accessible, the law empowers immigrant youth—many of whom have spent the majority of their lives in Texas—to pursue degrees, build careers, and contribute fully to their communities and the economy.
 
And the benefits extend beyond the classroom. In 2021 alone, Dream Act students contributed over $81 million in tuition and fees to Texas colleges and universities. According to economic studies, repealing the law would have cost the state an estimated $461 million annually in lost economic activity.
