A Challenging Case Involving Allegations of Immigration Fraud

ASIRILAW, PLLC is pleased to announce the approval of a Form I-601 Application for Waiver of Grounds of Inadmissibility on behalf of a client residing in Nigeria whose immigrant visa application had been denied due to allegations of prior immigration fraud.

The case came to our office in June 2025 after years of uncertainty and unsuccessful efforts to resolve the matter. The applicant's U.S. citizen daughter sought our assistance after previous lawyers had failed to secure a favorable outcome. By the time the case reached our office, the record contained substantial adverse evidence and significant legal obstacles.

At first glance, the case appeared extremely difficult.

Identifying What Others Missed

When we reviewed the file, we determined that the case required a fresh legal analysis and a comprehensive review of the underlying record. Thus, we filed a FOIA request to retrieve the records from USCIS. Rather than focusing solely on the adverse findings, we examined the case from every angle, identifying legal and factual issues that had not been fully developed.

Our team conducted an extensive review of the evidence, worked closely with the family to gather supporting documentation, and developed a strategy tailored to the specific facts of the case.

We prepared a detailed legal brief and submitted substantial supplemental evidence in support of the pending Form I-601 waiver application. Our submission addressed the government's concerns while presenting the favorable equities and discretionary factors supporting approval.

USCIS Approves the Waiver

On June 22, 2026, USCIS approved the client's Form I-601 Waiver Application.

The approval represents a significant milestone for the family. By obtaining the waiver, the applicant successfully overcame a ground of inadmissibility that otherwise could have prevented her from immigrating to the United States and reuniting with her loved ones.

The Importance of Experienced Waiver Representation

Cases involving allegations of fraud or misrepresentation are among the most legally complex matters in immigration law. These cases often require careful analysis of the record, strategic development of evidence, and persuasive legal advocacy.

While every case is unique, this approval serves as a reminder that difficult cases should not be abandoned without a thorough legal evaluation. In some situations, the key to success lies in identifying legal issues, factual distinctions, or discretionary factors that may not have been adequately presented previously.

We Are Honored to Help Families Reunite

At ASIRILAW, PLLC, we are grateful for the trust our clients place in us during some of the most challenging moments of their lives. We are honored to have helped this family move one step closer to reunification in the United States and look forward to assisting them through the remaining stages of the immigration process.

Have You Been Found Inadmissible?

A denial is not always the end of the road. If you or a loved one has been denied an immigrant visa, found inadmissible for fraud or misrepresentation, or needs assistance with an I-601 waiver application, experienced legal representation can make a difference.
